Content of consumer transactions are extended and the fundamental principles that shall be applied to all consumer transactions are regulated under the Consumer Protection Law numbered 6502. One of the main principles is that all personal guaranties given for the purpose of consumer transactions are accepted as surety. Personal guarantees given under the scope of consumer transactions shall bear the consequence of execution surety agreements. A surety agreement is an ancillary and a secondary agreement in which the surety undertakes to be personally liable against the creditor for the consequences of which the creditor’s non-performance of the obligation. Obligation of accepting all personal guaranties given under the purpose of consumer debts as ordinary suretyship is imposed, therefore, personal suretyship is promoted and protection of guarantor is aimed as per the said principle. The rule of acceptance of personal guaranty for the consumer debts as joint surety is governed, thus it is aimed to make a regulation protection the consumers.
